  1. Introduction and Acceptance

    Welcome to the Filipino Societies, Individuals, Businesses, Organizations, and Leaders in Germany (hereinafter referred to as "the System" or "Filipino SIBOL") operated by the Philippine Consulate General in Frankfurt , Germany (hereinafter referred to as "the Consulate"), a duly constituted foreign service post of the Republic of the Philippines under the Department of Foreign Affairs (DFA).

    By accessing, registering, or using the Filipino SIBOL, you (hereinafter referred to as "User" or "you") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these Terms and Conditions, you must immediately discontinue use of the System.

  2. Definitions

    For the purposes of these Terms and Conditions, the following definitions shall apply:

    • "Filipino SIBOL" or "System" refers to the online platform managed by the Philippine Consulate General in Frankfurt for registration, information management, and community engagement of Filipino businesses and organizations in Germany.
    • "User" refers to any individual who creates an account, accesses, browses, or otherwise uses the System.
    • "Content" refers to any text, images, photographs, graphics, promotions, event listings, announcements, or other materials uploaded, submitted, or posted by Users through the System.
    • "Events and Promotions" refers to announcements, activities, offers, or programs posted by Users on the System's community board or similar features.
    • "Account" refers to the registered profile created by a User to access the System's features.
    • "Consulate" refers to the Philippine Consulate General in Frankfurt, Germany.
    • "Registered Business" refers to a business that is duly registered in Germany and holds a valid German tax or VAT identification number.
    • "Registered Organization" refers to an organization registered as an eingetragener Verein in Germany

  3. Eligibility and Account Registration

    3.1 General Eligibility

    The Filipino SIBOL is primarily intended for Filipino nationals residing in Germany. By registering, you represent and warrant that:

    • You are at least eighteen (18) years of age, or are a minor registering with the express consent and supervision of a parent or legal guardian.
    • You have the legal capacity and authority to enter into these Terms and Conditions.
    • All information you provide during registration is accurate, current, and complete.
    • You will maintain and promptly update your account information to keep it accurate and complete.

    3.2 Business Registration Eligibility

    Registration of a business account on the System is limited to Filipino-owned or Filipino-themed businesses that are duly registered in Germany. By registering a business on the System, you further represent and warrant that:

    • The business is duly registered in Germany in accordance with applicable German law.
    • You will provide the valid German VAT identification number of the business. If the business does not have an assigned VAT identification number, you will provide its valid tax identification number instead.
    • You are the owner of the business or an authorized representative of the business.
    • You acknowledge and agree that for publicly listed businesses, the VAT identification number provided will be displayed as part of your business listing on the System.

    The Consulate reserves the right to reject, suspend, or terminate any business registration that does not comply with these requirements or that is found to contain false, inaccurate, or misleading information.

    3.3 Organization Registration Requirements

    By registering an organization on the System, you represent and warrant that:

    • You will provide accurate information including the place of registration and registration number (for registered organizations).
    • You are the leader or president or an authorized representative of the organization.

    The Consulate reserves the right to reject, suspend, or terminate any organization registration information.

    3.4 Account Creation

    To access certain features of the System, Users must create an account by providing the required registration information. You are responsible for:

    • Safeguarding the confidentiality of your account credentials, including your username and password.
    • All activities that occur under your account, whether or not authorized by you.
    • Immediately notifying the Consulate of any unauthorized use of your account or any security breach.

    The Consulate reserves the right to suspend or terminate any account at its sole discretion if it determines that the account is being used in violation of these Terms and Conditions, applicable law, or in a manner detrimental to the interests of the Filipino community.

  4. User-Generated Content

    4.1 Image Uploads

    Users may upload images through the System subject to the following conditions:

    • Images must not contain obscene, pornographic, defamatory, discriminatory, violent, or otherwise inappropriate material.
    • You must own or have obtained appropriate rights, licenses, or permissions for any image you upload.
    • Images must not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
    • The Consulate reserves the right to remove any image without prior notice if it determines, in its sole discretion, that the image violates these Terms and Conditions or is otherwise inappropriate.

    4.2 Events and Promotions

    Users may post events and promotions on the System. By posting any event or promotion, you agree to the following:

    • All posted events and promotions must be lawful, honest, and not misleading.
    • You represent and warrant that you are duly authorized to promote or advertise the event or promotion you post.
    • You shall not post events or promotions that are illegal, fraudulent, or that violate any applicable Philippine, German, or European Union laws and regulations.
    • You take full and sole responsibility for the accuracy, completeness, and legality of all information contained in any event or promotion you post.

    4.3 License Grant

    By submitting or uploading Content to the System, you grant the Consulate a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such Content solely for the purposes of operating and promoting the Filipino SIBOL and its community services.

  5. DISCLAIMER OF LIABILITY FOR EVENTS AND PROMOTIONS

    IMPORTANT NOTICE: THE PHILIPPINE CONSULATE GENERAL IN FRANKFURT DOES NOT ENDORSE, VERIFY, APPROVE, OR GUARANTEE THE ACCURACY, LEGITIMACY, OR AUTHENTICITY OF ANY EVENT OR PROMOTION POSTED BY USERS ON THIS SYSTEM. THE CONSULATE IS NOT RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, HARM, OR INCONVENIENCE ARISING FROM OR IN CONNECTION WITH USER-POSTED EVENTS AND PROMOTIONS.

    5.1 The Consulate serves solely as a platform provider and does not act as an organizer, sponsor, endorser, or guarantor of any event or promotion posted by Users. The presence of an event or promotion listing on the System does not constitute an official endorsement or recommendation by the Consulate or the Republic of the Philippines.

    5.2 It is the sole and exclusive responsibility of each User to exercise due diligence in verifying the authenticity, legitimacy, and accuracy of any event or promotion before participating in, attending, or relying upon it. This includes, but is not limited to:

    • Independently verifying the identity and credibility of the event organizer or promoter.
    • Confirming the details of the event or promotion directly with the organizing party.
    • Assessing the risks associated with participating in any event or promotion.
    • Seeking independent legal or financial advice where appropriate.

    5.3 The Consulate expressly disclaims all liability for any personal injury, financial loss, property damage, reputational harm, or any other loss or damage of any nature arising from or in connection with any event or promotion posted on the System, whether caused by negligence, fraud, misrepresentation, or any other cause.

    Users who discover fraudulent, misleading, or otherwise suspicious events or promotions are strongly encouraged to report such content to the Consulate using the contact details provided in Section 12 of these Terms and Conditions.

  6. Prohibited Conduct

    Users are strictly prohibited from using the System to:

    • Post, upload, or transmit Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
    • Impersonate any person or entity, or falsely represent an affiliation with the Consulate, the Philippine government, or any other organization.
    • Solicit personal information from minors or engage in any conduct that could harm or exploit children.
    • Engage in unauthorized data collection, scraping, or harvesting of User information.
    • Transmit unsolicited commercial messages, spam, or chain letters.
    • Upload malware, viruses, or any other malicious code.
    • Attempt to gain unauthorized access to other Users' accounts or the System's infrastructure.
    • Post Content that violates any applicable law, including but not limited to Philippine law, German law, and European Union regulations.
    • Use the System for any commercial purpose without the prior written consent of the Consulate.

  7. Intellectual Property

    7.1 All intellectual property rights in the Filipino SIBOL, including its design, software, logos, and official content, are owned by or licensed to the Philippine Consulate General in Frankfurt. Nothing in these Terms and Conditions shall be construed as granting any license or right to use such intellectual property without the express prior written consent of the Consulate.

    7.2 Users retain ownership of original Content they upload, subject to the license granted in Section 4.3. The Consulate does not claim ownership of User-generated Content.

  8. Modifications to the System and Terms

    The Consulate reserves the right, at any time and without prior notice, to:

    • Modify, suspend, or discontinue the System or any of its features.
    • Amend, update, or replace these Terms and Conditions.

    Updated Terms and Conditions shall take effect upon posting on the System. Continued use of the System following any modification constitutes acceptance of the revised Terms and Conditions. Users are encouraged to review these Terms and Conditions periodically.

  9. Suspension and Termination

    The Consulate reserves the right to suspend or permanently terminate a User's account with or without prior notice if the User:

    • Violates any provision of these Terms and Conditions.
    • Engages in conduct that is harmful to other Users, the Consulate, or the general public.
    • Provides false or misleading information during registration or while using the System.

    Upon termination, the User's right to access and use the System shall immediately cease. The Consulate may, but is not obligated to, retain User-generated Content following account termination, subject to applicable data protection laws.

  10. Governing Law and Dispute Resolution

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, to the extent applicable to overseas operations of Philippine foreign service posts. Users also acknowledge that German law and European Union regulations may apply to the extent required by law.

    Any disputes arising from the use of the System shall first be addressed through informal consultation with the Consulate. If resolution cannot be reached informally, the matter shall be referred to the appropriate legal authorities in accordance with applicable law.

  11. Limitation of Liability

    To the maximum extent permitted by applicable law, the Consulate, its officers, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the System, including but not limited to:

    • Unauthorized access to or alteration of your transmissions or data.
    • Loss or damage caused by any Content posted on the System.
    • Any harm arising from User-posted events or promotions, as further described in Section 5.
    • Technical failures, interruptions, or errors in the System.
